Solmare


Article 1 — Identity of the Seller

Article 2 — Applicability

2.1. These general terms and conditions apply to all offers, orders and agreements between Solmare and the customer, concluded via the webshop www.solmare.be.

2.2. By placing an order, the customer declares to have read these general terms and conditions and to expressly agree to them.

2.3. Deviations from these terms are only valid if agreed in writing.

2.4. Solmare reserves the right to amend these terms. Amendments do not apply to orders already placed.


Article 3 — Offer and Product Information

3.1. All products are described as accurately as possible, including the main features, dimensions and materials. Minor variations in colour or size may occur due to screen display or production tolerances.

3.2. The offer is valid while stocks last. Solmare cannot be held liable for the temporary or permanent unavailability of a product.

3.3. Obvious errors or mistakes in the offer, such as an incorrectly displayed price, are not binding on Solmare.

3.4. Products are delivered directly from the supplier’s warehouse. Solmare acts as seller and is your sole point of contact for all questions and complaints.


Article 4 — Prices

4.1. All stated prices include VAT (21%, unless otherwise indicated) and exclude shipping costs, unless expressly stated otherwise.

4.2. Shipping costs are displayed separately before completing the order, so the customer knows the total price (including all costs) before paying.

4.3. Any payment charges (e.g. transaction fees for certain payment methods) are passed on in accordance with the actual cost and are clearly displayed in the ordering process.

4.4. Solmare reserves the right to change prices. Orders already placed are always processed at the price that applied at the time of ordering.


Article 5 — Order and Formation of the Agreement

5.1. An order is placed via the webshop by completing the ordering process and clicking the “Order with payment obligation” button (or equivalent wording). By clicking this button, the customer expressly acknowledges that the order entails a payment obligation.

5.2. After placing the order, the customer receives an automatic order confirmation by email. This confirmation serves as a receipt but does not yet constitute definitive acceptance.

5.3. The agreement is definitively concluded once Solmare accepts the order and sends a shipping confirmation.

5.4. Solmare reserves the right to refuse an order, for example in cases of suspected fraud or incorrect data, and will notify the customer accordingly.


Article 6 — Payment

6.1. The customer can pay via the payment methods offered in the ordering process, including: Bancontact, credit card (Visa/Mastercard), iDEAL, PayPal, …

6.2. Payment must be made when placing the order, unless expressly agreed otherwise.

6.3. In the event of late payment, Solmare is entitled to cancel the order or suspend delivery.


Article 7 — Delivery

7.1. Delivery period: Orders are generally processed and dispatched within 2–5 business days of receipt of payment. The statutory maximum delivery period is 30 calendar days, unless a different period has been expressly agreed.

7.2. Delivery methods: In accordance with Belgian legislation (Art. VI.45/2 CEL, in force from 21 September 2024), Solmare offers at least two delivery options: - Home delivery — the parcel is delivered to the delivery address provided by the customer - Delivery to a collection point — the customer collects the parcel at a nearby service point or parcel locker

7.3. Deliveries are handled by external transport partners (including GLS, DPD, PostNL or equivalent carriers), depending on the destination and product type.

7.4. For large or heavy products, delivery may take place on a pallet basis, with delivery to the front door or driveway (not inside the building).

7.5. If a delivery is delayed, Solmare will inform the customer as soon as possible. If the delivery period is exceeded, the customer has the right to dissolve the agreement free of charge, after which Solmare will refund the amount paid within 14 calendar days.

7.6. The risk of damage to or loss of the goods passes to the customer upon delivery.


Article 8 — Right of Withdrawal (Cooling-off Period)

8.1. As a consumer, you have the right to withdraw from the agreement within 14 calendar days of receipt of the product, without giving any reason. This right derives from the European Consumer Rights Directive (2011/83/EU) and the Belgian Code of Economic Law.

You may use the model withdrawal form (see Annex 1 at the end of these terms).

8.3. After notifying withdrawal, you have 14 calendar days to return the product.

8.4. Solmare will refund the purchase amount within 14 calendar days of receipt of the return shipment or proof of return, whichever is earlier.

8.5. Refunds are made via the original payment method, unless expressly agreed otherwise.

8.6. Return costs upon withdrawal are at the customer’s expense, unless the product was defective or incorrectly delivered. The customer will be informed of this upon the return request.

8.7. Any diminution in value resulting from use beyond what is necessary to establish the nature, characteristics and functioning of the product may be charged.


Article 9 — Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

         Products specially made to order or to the customer’s specifications

         Sealed products that cannot be returned for hygiene reasons once opened

         Perishable goods or goods with a short shelf life

         Products that after delivery have been inseparably mixed with other products

         Digital content that has already been downloaded or opened with the consumer’s express consent


Article 10 — Warranty

10.1. Solmare guarantees the conformity of the delivered products to the agreement. Under the Belgian Code of Economic Law (Art. 1649bis et seq.), the consumer benefits from a statutory conformity guarantee of 2 years from delivery.

10.2. In addition to the statutory warranty, products carry a manufacturer’s warranty of 2 years.

10.3. The warranty does not cover damage caused by: - Improper use or normal wear and tear - Repairs or modifications carried out independently - External influences such as fire, water or mechanical damage by the customer.

10.4. For a warranty request, please contact us via support@solmare.be with your order number, a description of the issue and photos where applicable.


Article 11 — Complaints and Dispute Resolution

11.1. For complaints, please contact us as soon as possible via support@solmare.be. Solmare aims to respond to complaints within 5 business days.

11.2. If an amicable resolution is not possible, recourse may be had to the competent bodies for out-of-court dispute resolution. An overview of recognised ADR bodies in Belgium and Europe is available via: https://consumer-redress.ec.europa.eu/dispute-resolution-bodies

11.3. All agreements concluded via Solmare are governed by Belgian law.

11.4. In the event of disputes, the Enterprise Court of Leuven has exclusive jurisdiction, without prejudice to the right of the consumer to bring proceedings before the court of their place of residence.


Article 12 — Liability

12.1. Solmare is not liable for indirect damage, consequential damage or loss of profit.

12.2. Solmare’s liability is in any case limited to the amount of the relevant order.

12.3. Solmare is not responsible for delays or non-performance resulting from force majeure (e.g. strikes, extreme weather conditions, pandemic, disruption of transport networks).


Article 13 — Personal Data

13.1. Solmare processes personal data in accordance with the General Data Protection Regulation (GDPR) and Belgian privacy law. Please consult our Privacy Policy for full details.

13.2. Customer data is used solely for the performance of the agreement and is never shared with third parties for commercial purposes without consent.


Article 14 — Intellectual Property

14.1. All content on the webshop (texts, images, logos, product descriptions) is the property of Solmare or its licensors and may not be reproduced without express written permission.


Article 15 — Miscellaneous Provisions

15.1. If any provision of these terms proves invalid or unenforceable, the remaining provisions remain in full force.

15.2. Solmare reserves the right to temporarily or permanently modify or discontinue the webshop without prior notice.
